Introduction cyber law

  • The primary source of cyber law in India is the Information . Technology Act, 2000 (IT Act) which came into force on 17 October 2000. The primary purpose of the Act is to provide legal recognition, to electronic commerce and to facilitate filing of electronic records with the Government.(CYBER CRIME LAW)
  • Cyber crimes are unlawful acts. where the computer is used either as a tool or a target or both. The enormous growth in electronic commerce (e-commerce). and online share trading has led to a phenomenal spurt in incidents of cyber crime. These crimes are discussed in detail further in this chapter.   • Action is taken under Section 77B of IT Act 2000. and Section 66D of IT Amendment 2008 and Section 417,419,420 and 465 of IPC.
  • Punishment for such offenses, can be up to three years in jail or a fine of up to 5 lakhs.

DATA THEFT

  • On a convict in such a crime Action is taken under Section. 43B ,Section 66E,66C and Section 66D of IT Amendment 2008 and Section 379,405 and 420 of IPC.(CYBER CRIME LAW)
  • If data theft is proved to be a crime Punishment,for such offenses can be up to three years in jail or a fine of up to 2 lakhs.

Harass on social networking site

  • Action is taken under Section 66A of IT Act 2009 Punishment , for such offenses can be up to three years in jail or a fine.

WhatsApp Hacking cyber law

  • On WhatsApp hacking Action is taken under Section 43A of IT Act 2008 and Section 66 and Section 379 406 of IPC.(CYBER CRIME LAW)
  • Punishment for such offenses can be up to three years in jail or a fine of up to 5 lakhs.

Virus-spyware

  • If someone creates such a virus and transmits it to a system. Action is taken under Section 43C and Section 66 of IT Amendment 2008 and Section 268 of IPC. and if such a virus is spread to endanger the security of the country, then action will be taken under 66F.
  • Punishment for such offenses can be up to three years in jail or a fine of up to 5 lakhs. and if such a virus is spread to endanger the security of the country Life imprisonment can also be punished.

How to stop cyber crime law

  • To prevent cybercrime, we should first spread digital / technology awareness among people.
  • To prevent this, every district should have cyber police stations.
