Terms of Service for KAMALDNP

Welcome to KAMALDNP! These Terms of Service ("Terms") govern your use of our website, courses, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

1. Definitions

  • "Platform" refers to the KAMALDNP website, including all its content, features, and services.
  • "User," "You," and "Your" refer to any individual who creates an account or uses our Services, including students and visitors.
  • "Content" refers to all course materials, including videos, lectures, notes, quizzes, assignments, projects, and any other materials provided through our Services.
  • "Instructor" refers to the individual or entity responsible for creating and teaching the course content.

2. User Accounts and Responsibilities

2.1. Eligibility

To use our Services, you must be at least 18 years of age or have the consent of a parent or legal guardian. By creating an account, you represent and warrant that you meet this requirement.

2.2. Account Registration

You must provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3. Account Security

You are prohibited from sharing your account credentials with any third party. A single account is meant for a single user. We reserve the right to suspend or terminate your account if we suspect any unauthorized activity or sharing of account access.

3. Course Enrollment and Access

3.1. License to Content

Upon successful payment for a course, KAMALDNP grants you a limited, non-exclusive, non-transferable license to access and view the course Content for your personal, non-commercial, educational purposes. This license does not grant you any right to resell, redistribute, or publicly share the Content in any way.

3.2. Access Duration

The duration of access to course Content may vary. Unless otherwise specified at the time of purchase, we grant lifetime access to the recorded materials of the course you enrolled in. "Lifetime access" refers to the lifetime of the Service, not the user's lifetime. We reserve the right to revoke access if the Platform is discontinued, in which case we will provide you with a reasonable notice period to download any available materials.

4. Payments, Fees, and Refunds

4.1. Pricing

The fees for courses are listed on our Platform and are subject to change without notice. All prices are quoted in Indian Rupees (INR). You agree to pay the fees for the courses you purchase, and you authorize us to charge your selected payment method.

4.2. Payment Processing

We use third-party payment gateways (e.g., Razorpay, Cashfree) to process payments. We are not responsible for any errors, fees, or issues arising from the payment processor. By making a payment, you agree to the terms and conditions of the respective payment gateway.

4.3. Refund Policy

Our refund policy is designed to be fair and transparent. You may be eligible for a refund under the following conditions:

  • A refund request must be submitted within 7 days of the course purchase date.
  • You must not have accessed or viewed more than 25% of the total course content (including videos, notes, and other resources).
  • Refunds will not be provided for any course after the 7-day period has elapsed or if significant portions of the content have been consumed.
  • Any promotional offers or cashback schemes are subject to their own specific terms and are not covered under this standard refund policy.

All refunds are subject to our review and will be processed to the original payment method within 14 business days of approval.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated "scraping."
  • Using any automated system, including "robots," "spiders," etc., to access the Service.
  • Transmitting spam, chain letters, or other unsolicited email.
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Uploading invalid data, viruses, worms, or other software agents through the Service.
  • Harassing, abusing, or harming another person, including instructors and other students.
  • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.
  • Cheating on any assignment, quiz, or project. This includes plagiarism and submitting work that is not your own.

6. Intellectual Property Rights

All Content on the Platform is the exclusive property of KAMALDNP and its instructors. Our Content is protected by copyright, trademark, and other intellectual property laws. You may not use our brand name, logo, or any proprietary graphics without our prior written consent.

7. Certificates

We may offer a Certificate of Completion upon successful fulfillment of a course's requirements. These requirements typically include viewing all modules, submitting all assignments, and passing any required tests. This certificate is an acknowledgment of your participation and does not constitute a formal academic credit or professional accreditation.

8. Disclaimers and Limitation of Liability

8.1. No Guarantee of Success

While we are committed to providing high-quality educational content, we do not guarantee any specific outcomes, such as job placement, career advancement, or skill proficiency. Your success depends on your own effort, dedication, and background.

8.2. Service "As Is"

The Services and Content are provided on an "as is" and "as available" basis without any warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8.3. Limitation of Liability

To the maximum extent permitted by law, KAMALDNP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of our Services.

9. Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Varanasi, Uttar Pradesh.
